Areas of Practice
Representing and counseling media clients in copyright, trademark, defamation, privacy and other media law matters, as well as complex commercial litigation and intellectual property transactions. Acting as primary outside media/IP counsel for clients in publishing, television, consumer products, online information businesses and performing arts. Representing coalitions of media companies and organizations in significant copyright and First Amendment cases, often as amici curiae.

Selected Experience
Representing the Magazine Publishers of America, the Newspaper Association of America and many magazine and newspaper publishers as amici curiae in litigation over publishers’ rights to create digital replicas of their periodicals under Section 201(c) of the Copyright Act

Defending a foreign broadcaster against claims of copyright infringement, defamation and commercial torts based on a television program broadcast abroad and materials posted on the internet

Acting as lead counsel for a coalition of publishers' and authors' organizations challenging the application of U.S. trade embargoes to the publication of books and articles by authors in Cuba, Iran and Sudan

Serving as primary outside intellectual property counsel for a prominent media and consumer goods company

Securing First Amendment protection for statements on the covers of a best-selling series of books in a class action alleging consumer fraud

Successfully representing a multinational publisher in litigation over the acquisition of popular intellectual property assets of a former competitor in bankruptcy

Conducting internal investigations of highly publicized charges of abuse of authority and financial misconduct against prominent leaders in an international organization

Representing national magazines in quashing third-party subpoenas in tobacco class actions

Representing leading art museums and other cultural institutions across the country as amici curiae in the First Amendment litigation over the City of New York’s unsuccessful efforts to punish the Brooklyn Museum of Art for a controversial exhibition

Winning dismissal of consumer complaints of indecency against a cable television network

Securing the release of the reformist former Chairman of the Palestinian National Fund from house arrest by Yasir Arafat, winning a ruling against the Palestinian Authority from the United Nations High Commissioner for Human Rights and gaining the support of several governments, multinational organizations and Palestinian reformers

Defending a magazine against a major television producer’s claims for libel and violation of the Lanham Act

Winning the protection of the reporter’s privilege for an investigative journalist who became part of the story, running for the board of a company he was covering and testifying at regulatory hearings

Serving as a leader of the plaintiffs’ steering committee that won a jury verdict of negligence against the Port Authority for the 1993 World Trade Center bombing, representing a prominent bond brokerage whose business was severely interrupted

Prior Experience
Conducted test-case constitutional litigation for five years with the Legal Action Center, a public-interest law firm in New York and Washington, D.C., founded and chaired by Arthur Liman; previously associated with the international law firm Coudert Brothers

Newspapers, magazines and book publishers; cable and broadcast television networks; design firms; a leading media and home products company; a prominent international securities broker; a major law firm; authors, artists and their estates; nonprofit organizations and advocacy groups

Publications and Presentations
Frequent speaker and continuing legal education instructor, especially on intellectual property and media law

Author of numerous articles for publications on communications law, primarily focused on First Amendment and intellectual property issues, and co-author of the chapters on China and Hong Kong in the International Libel and Privacy Handbook (Bloomberg 2006)
