Advise and represent media and other clients on both online and print matters, including defamation, privacy, advertising, access to public records, other First Amendment issues, the CAN-SPAM Act of 2003, copyright, trademark, domain names, and the breadth of immunity afforded online publishers by Section 230 of the Communications Decency Act
Representative Experience
Fair Housing Council of San Fernando Valley, et. al. v. Roommates.com, LLC, No. 04-56916 (9th Cir. Apr. 4, 2008) (en banc): Assisted in drafting of amicus brief on behalf of numerous media amici in case involving scope of immunity afforded by Section 230 to websites for both pure third-party content and third-party content mixed with website’s own content.
Dibbs v. The Franklin Mint. et al., No. CV06-604 RSM (W.D. Wash. 2006-2007): Assisted in representation of defendant in copyright infringement dispute concerning use of photographs, resulting in successful settlement.
Browne v. Avvo, Inc., 525 F. Supp. 2d 1249 (W.D. Wash. 2007): Assisted in representation of attorney evaluation website, resulting in successful motion to dismiss on First Amendment opinion grounds, with court also holding that distribution of information is not "commerce" under state consumer protection law.
