Representative Experience
Civil litigation in both state and federal courts since 1963

Provides alternative dispute resolution services throughout the Pacific Northwest in the field of torts and real estate, as well as in cases involving environmental and natural resources issues and employment law

Representative Cases:

Clark v. Michelle & Dickinson and International Multifoods Corp. Representation of defendant in state Superfund law claim.

Eastern Oregon Public Land Coalition, Oregon Natural Desert Association v. U.S. Forest Service. Representation of intervenor-defendant in Case of First Impression under §401 of Federal Clean Water Act. Representation of client-intervenor on appeal to 9th Circuit Court of Appeals and successfully defended against Petition for Certiorari in U.S. Supreme Court.

Lake County v. State of Oregon. Representation of Lake County in trial and appellate courts on action under state surplus land laws.

Mendieta v. State of Oregon. Representation in trial and appellate courts of plaintiff representing a class of approximately 150 cattle ranchers over issues relating to grazing leases on state lands.

Merritt Truax v. Shell Oil Co. Representation of defendant in state Superfund and common law claims.

Newell v. Weston. Representation of defendant in trial and on appeal in cost recovery and state Superfund and common law claims.

Schnitzer Investment Corp. v. Time Oil, Mitsubishi International Co. and Premier Edible Oil. Representation of defendant.

Oliver Spires dba Rivers End Ranch v. United States et al. Defended suits by five Native American tribes also involving Federal and State government. Pursuant to Native American Grave Protection Act and Clean Water Act. Related state and federal claims. Representation provided on appeal and defense of a Petition for Certiorari in the U.S. Supreme Court.

Burns, et al. v. MBK Partnership, el al. Representation of the defendants against claims involving alleged asbestos contamination of a housing development and related enforcement action brought by the EPA and related insurance coverage claims against multiple carriers.
