Jake Freed is a litigator with experience across a wide range of practice areas and industries. His practice focuses on financial services litigation, class action defense, intellectual property enforcement and brand protection for technology companies, and commercial disputes across industries.

Jake's broad litigation experience in federal and state courts, in California and beyond, combined with his extensive background in science and teaching, enables him to deliver strong advocacy and insightful command of the facts and law, in any type of case, for any type of client. His experience as the founder and CEO of a small business gives him a unique business-focused perspective on litigation.

Practice Highlights

Financial services and class action litigation

Defends financial institutions in litigation arising from consumer banking disputes and mortgage lending activities, with a focus on class actions in federal and state courts nationwide. Represents businesses across additional sectors, including technology and healthcare, in class actions.

Brand protection and technology litigation

Represents technology companies, including Amazon, Microsoft, and Meta in a range of matters involving trademark and copyright enforcement, and state law claims.

Commercial disputes

Represents businesses in a wide range of commercial disputes, including those to enforce contracts, and resolve vendor, partner, real estate, employee, and customer disputes. Leverages first-hand experience as a business owner in the restaurant industry to bring a unique perspective and add value on behalf of business clients.

Financial Services Litigation & Class Actions

JPMorgan Chase mortgage banking disputes

Defending Chase in over 100 California mortgage banking disputes in California Superior Court, U.S. District Court, U.S. Bankruptcy Court, California Court of Appeal, and the 9th Circuit Court of Appeals. Every case handled resulted in dismissal with prejudice or a successful settlement. Cases involve quiet title, breach of contract, fraud, and negligence claims, as well as statutory claims under Federal and California law. (2015-present)

Zions Bancorporation NSF fee class actions

Defending Zions Bank in a series of putative class actions surrounding NSF and overdraft fees. Obtained dismissals in the District of Arizona, District of Utah, and Southern District of California. (2021-2023)

Villanueva v. Rabobank

Defending Rabobank in a putative class action alleging claims regarding negative-balance fees and enrollment in optional overdraft protection. (Contra Costa Cty. (Cal.) Sup. Ct.; N.D. Cal. Ongoing)

Liou v. Capital One

Defending Capital One in putative class action alleging claims under the federal Fair Credit Reporting Act. (D.N.J. Ongoing)

Lead counsel in substantial pro bono engagement on behalf of lawful permanent resident in multiple proceedings, including two separate federal habeas matters and all aspects of administrative removal litigation.
