Restructure and Workout Transactions
Davis Wright Tremaine has one of the leading creditor
bankruptcy and workout practices in the western United States.
In particular, we regularly counsel secured lenders in workout negotiations
with, and bankruptcies of, large and mid-sized corporate borrowers.
For example, we represent General Electric Capital Corporation throughout
the United States on bankruptcy and commercial law matters. We are
also Bank of America's primary bankruptcy counsel in the Pacific
Northwest. Our lawyers have also had substantial experience negotiating
with the FDIC, FSLIC and RTC and their lawyers on behalf of our
lending clients.
Banking
and Consumer Credit Regulations
Our firm has represented the financial industry before legislative
bodies and regulatory agencies for more than 50 years. We have been
deeply involved in the development of Idaho, Oregon and Washington
consumer credit disclosure legislation and the continuous updating
of the state banking codes. We frequently consult with state agencies
on behalf of financial institutions. The firm has served as counsel
in the development of open and closed-end consumer credit programs,
including initiation of a variable rate open-end consumer credit
program and the development of a home equity loan program in Oregon.
The firm represents an Internet payment company in all aspects of
electronic banking and payment transfers. Davis Wright Tremaine
is frequently called upon to counsel financial institutions from
around the country that wish to solicit consumer credit business
from Northwest residents. We have substantial experience regarding
state laws and regulations that govern such programs -- including
equal opportunity requirements and marketing restraints. We are
also experienced in credit insurance including credit life and disability,
and VSI coverages.
Public
Finance
Lawyers in the Finance and Commercial Law Practice Group have experience
in representing commercial banks in each of the various roles that
commercial banks play in public finance transactions. This experience
includes representation of banks in their roles as issuer of letters
of credit supporting municipal bond transactions, as placement agent
for bonds and other securities, and as trustee for purchasers of
