On Tuesday July 23, DWT Supervision, Enforcement, and Litigation team co-leader Bradford Hardin participated in a panel for the 31st National Forum on Consumer Finance Class Actions and Government Enforcement. Bradford led a presentation on recent developments and risk abatement tactics in debt collection litigation and enforcement. The panel covered trends in FDCPA litigation, discussing topics such as key U.S. Court of Appeals decisions on statutes of limitations, time-barred debts, and what constitutes a debt collector.
Bradford’s presentation further touched on proposed rule changes for a “limited-content message” definition, procedures for text and email communication, call frequency, validation of debt and other disclosures, opt-outs, and other provisions. Finally, Bradford’s presentation examined recent CFPB enforcement actions, particularly the case of Obduskey vs. McCarthy and Holthus, LLP.
