Valenzuela v. The Kroger Co.
Won dismissal of putative class action alleging The Kroger Co. violated the California Invasion of Privacy Act (CIPA) by aiding its webchat vendor to "eavesdrop" on customer-service webchats. Won dismissal on novel ground that the plaintiff failed to allege Kroger intended to aid in eavesdropping. No. CV 22-6382-DMG (AGRX), 2025 WL 851075 (C.D. Cal. Mar. 13, 2025). Heinz v. Amazon.com, Inc.
Won dismissal of putative class action alleging Amazon.com Inc. violated CIPA by aiding its webchat vendor to "eavesdrop" on customer-service webchats. Won transfer by enforcing forum-selection clause in Amazon's Conditions of Use (COUs), No. 2:23-CV-00282 WBS AC, 2023 WL 4466904 (E.D. Cal. July 11, 2023), won application of Washington law by enforcing choice-of-law provision in COUs, No. 2:23-CV-1073, 2024 WL 2091108 (W.D. Wash. Navarro v. Ski Data
Represented Park Assist LLC in a putative class action alleging parking assistance technology violated state privacy laws, including California's Automated License Plate Recognition (ALPR) statute. Plaintiffs sought statutory penalties for every individual who parked at Southern California's largest malls for a four-year period, threatening potential liability of over $1 billion. Won summary judgment finding Park Assist was not an "operator" subject to the ALPR law, the ALPR law contains a harm requirement, and plaintiffs failed to adduce evidence of harm.
