Mark Anishchenko is a member of DWT's healthcare and litigation practice groups. His healthcare practice focuses on representing hospitals and healthcare providers in managed care disputes involving complex medical billing and reimbursement matters with commercial, Medicare Advantage, and managed Medi-Cal health plans. He has served as second chair in disputes involving health plans' claims-processing failures, improper MS-DRG downcoding practices, and medical necessity denials, and he has taken the deposition of health plans' clinical experts regarding the medical necessity of acute inpatient care.

Mark has also litigated commercial disputes in the construction, food and beverage, agricultural, and financial services industries. His commercial litigation experience includes representing a general contractor as first chair at bench trial. He assists clients in all stages of litigation, from pre-suit risk assessment and management to case strategy through trial.

MS-DRG downcoding practices and CARES Act compliance

Represented a hospital system in binding arbitration with a large commercial and Medicare Advantage health plan involving the use of improper clinical critera to deny medically necessary, authorized inpatient services and the plan's failure to accurately reimburse claims for COVID-positive patients in accordance with the CARES Act.

Reimbursement of continued acute inpatient care

Represented a hospital system in binding arbitration with a large Medi-Cal plan regarding the reimbursement of continued acute inpatient care while the patients were awaiting placement.

Reimbursement of acute inpatient care denied by commercial / MA plan

Represented a hospital system in binding arbitration with a large commercial and Medicare Advantage health plan involving medical necessity denials, level of care adjustments, and the plan's failure to accurately reimburse claims for COVID-positive patients in accordance with the CARES Act.
