As a litigator in Davis Wright Tremaine's communications group, Pat Curran provides legal solutions to his clients' business problems when things go sideways. He's not afraid of the courtroom and regularly appears in state and federal courts across the country. Pat has successfully tried and arbitrated more than a dozen cases as lead counsel, with a particular focus on disputes between companies and consumers. He's also successfully negotiated settlement agreements that protect his clients' financial interests and brand reputation. Pat takes the time to fully understand his clients' business needs and works closely with internal stakeholders to craft legal strategies that meet those needs in the most efficient and cost-effective manner possible.

While Pat spends a good amount of time representing tech giants that dominate the headlines, he also works with startups, mid-market companies, non-profits, and individuals. Pat leverages his experience and that of his colleagues to obtain favorable results for his clients, regardless of whether he's suing the government under the Freedom of Information Act or defending a telecom giant against claims of unfair and deceptive trade practices. Pat also has an active pro bono practice that has assisted clients with asylum claims, obtained housing vouchers from the D.C. Housing Authority, and defended against defamation claims based on Facebook comments.

Practice Highlights

Litigation

Helped defeat multiple putative class actions by enforcing arbitration provisions and has successfully defeated motions for class arbitration. Has successfully represented major technology firms in multiple individual consumer arbitration proceedings. Successfully defended major technology firms in dozens of state court bench trials over the last few years against a myriad of consumer claims.

Telecom infrastructure deployment litigation

Successfully represented cell phone and tower companies against localities in litigation under Section 332 of the Communications Act. This litigation helped the clients deploy their networks and facilities in a manner that allows for increased cell phone coverage and capacity and buildout of the country's 5G network.

Active pro bono practice

Pro bono experience has included assisting asylum seekers in gaining asylum and obtaining green cards, securing housing for indigent clients from D.C. Housing Authority, renegotiating contracts with vendors for non-profits affected by COVID-19, and representation of incarcerated individual in appeal of non-unanimous jury verdict in Louisiana. (Ongoing)

Energy Transfer Partners, et al. v. Greenpeace, et al.

Defending Greenpeace against wide ranging claims including trespass, conspiracy, and defamation related to Standing Rock protests against Dakota Access Pipeline. (N.D. Ongoing)

First Amendment litigation

Represented major media companies, journalists, and individuals to defend against defamation claims in state and federal court brought by a wide variety of plaintiffs, including former government officials, political activists, and foreign nationals.

Defense of progressive voter data company

Defended company that provides voter data to progressive groups and campaigns in "bet the company" trade secrets litigation, resulting in favorable settlement. (D.D.C. 2020)

Amazon small claims defense

Manage defense of all small claims and other actions filed in general district court against Amazon in Maryland, Virginia, and the District of Columbia. (Ongoing)

Representation of wireless carrier

Represented wireless carrier in litigation against municipality and zoning board following denial of a request for a permit to construct a stealth wireless tower. (D. Mass. 2020)
