Julie Capell partners with her clients to help them to comply with California and federal employment laws and regulations. She thinks of her clients' businesses as her own and strives to find economic, strategic and efficient ways to follow the law and avoid litigation risk. Julie keeps herself constantly informed of new legal developments and communicates those updates to her clients on a consistent basis. She is also an immediate responder and available to her clients at any time, day or night.

Julie is also a tenacious litigator and trial attorney, and has defended employers in all facets of employment litigation, including wrongful termination, harassment, discrimination, retaliation, and wage-and-hour class and representative actions. Finally, Julie is an accomplished trainer and presenter and regularly provides client trainings on harassment prevention, wage-and-hour compliance, and other employment laws.

Practice Highlights

Advice and counsel

Over fifteen years of experience providing strategic advice and counsel advice to companies in California, related to employment policies, handbooks, separation agreements, employment agreements, and best practices for conducting investigations, terminating employees, engaging in the interactive process, and dealing with trade secret issues.

Single plaintiff litigation

Defended over one hundred civil lawsuits brought by single plaintiffs alleging claims of wrongful termination, harassment, discrimination, retaliation, and wage-and-hour claims, in federal and California state court, as well as before California and federal administrative agencies, and has tried more than five cases to verdict in state and federal court and in arbitration.

Wage and hour class actions

Provided support and representation in defense of scores of wage-and-hour class and representative actions, in federal and state court, with a particular emphasis in meal and rest break, overtime, and misclassification (independent contractor and exemption) claims.

Summary judgment win and settlement for hospital

Obtained full dismissal for one hospital client on summary judgment. Obtained dismissal of eight out of nine causes of action for the other hospital entity on summary adjudication. Prepared for trial on the one remaining cause of action with a multi-million dollar damages claim, and negotiated a walk-away settlement less than 24 hours before trial was set to begin. (2022)

Disability discrimination claims for restaurant

Obtained unanimous defense verdict after a four-day trial for one of the world's largest restaurant companies in the United States District Court, Central District of California, in single-plaintiff lawsuit alleging disability discrimination, failure to provide a reasonable accommodation, failure to engage in the interactive process, and wrongful termination in violation of public policy. (C.D. Cal. 2019)

Settlement for furniture distributor*

Negotiated a walk-away settlement for a furniture distributor in an ADA disability access case. (2013)

Wage and hour trial for weight-loss supplement company*

Secured a defense verdict for a Fortune 100 weight-loss supplement company in a wage and hour trial in Los Angeles Superior Court. (2012)

Wrongful termination claims before the Court of Appeals*

Successfully argued on behalf of a Fortune 100 title insurance company and large medical association before the California Court of Appeals in two separate wrongful termination claims. (2008; 2011)
