James Moon defends companies in their most important business litigation matters. Whether representing market leaders or emerging ventures, James executes on a plan of action to end the litigation problem decisively from Day One. He measures success based on his ability to efficiently eliminate or minimize litigation exposure and to allow his clients to get on with running their businesses as quickly as possible.

James's practice involves a broad range of complex commercial litigation, with an emphasis on class actions, privacy claims, and consumer disputes. James has substantial experience in all aspects of federal and state civil litigation, including large-scale discovery, complex motion practice, and appeals. He also handles a broad portfolio of individual and mass arbitration matters. No matter the forum, James prides himself on his ability to secure swift and efficient resolution of high-exposure class action and consumer cases through successful dispositive pre-trial motions, oppositions to class certification, or motions for summary judgment. When necessary, James has obtained decisive victories for his clients after full trials and arbitration hearings, including complete defense victories and unanimous plaintiff's-side jury awards.

James provides actionable legal advice and roadmaps that cut through the noise of modern litigation so that his clients can focus on their business.

Practice Highlights

Class-action defense

James has represented dozens of companies in consumer, privacy, and securities class-action lawsuits. Each class action defense is unique but the goal is the same: minimize or eliminate the litigation exposure as early as possible. James has repeatedly achieved complete defense victories in class actions through early dispositive motions or motions for summary judgment. Representative actions in this space include Andrews v. Ring LLC (C.D. Cal.), Michigan First Credit Union v. T Mobile USA, Inc. (E.D. Mich.), Shenzen Shileziyou Techs. Co. v. Amazon.com, Inc. (N.D. Cal.), O'Neil v. The Kroger Co. (Los Angeles Sup. Ct.), and Grant v. NFL Players Association (C.D. Cal.)

Consumer disputes

When necessary, James resolves disputes between businesses and their customers. He quickly delivers actions to the proper forum based on the business's terms and conditions (e.g., arbitration), and resolves the claims swiftly, whether through a dispositive motion, favorable settlement, or a trial/merits hearing. Whether in court or arbitration, James's goal is to limit business disruptions. Representative actions include Handy v. LogMeIn Inc. (E.D. Cal.), Cheng v. T Mobile USA, Inc. (S.D.N.Y.), Rodriguez v. T-Mobile USA, Inc. (S.D. Cal.), Vitort v. The Kroger Co. (D. Or.), and various arbitration matters for Amazon, Microsoft, and T-Mobile.

Complex litigation

James is well-versed in all manner of complex commercial litigation and arbitrations, including contract disputes and lawsuits between businesses and vendors/competitors. His recent successes include a unanimous seven-figure jury verdict after a two-week federal trial in a copyright infringement action and a complete defense verdict after a state court bench trial. James has also obtained early injunctions to protect business assets and outright dismissals on dispositive motions. Representative actions include Charter School Capital Inc. v. Charter Asset Management LLC (C.D. Cal.), California Credits Group v. Williams Lea, Inc. (Los Angeles Sup. Ct.), Lighthiser v. EVR Foods, Inc. (S.D.N.Y.), Atlantis Events Inc. v. California Credits Group LLC v. Williams Lea, Inc.

Secured a complete defense verdict and attorneys' fees after a bench trial in a seven-figure breach of contract action initiated by a business's former vendor, affirmed in full on appeal. (Cal. Ct. App. 2022, 2022 WL 16569323)

Vitort v. The Kroger Co.

Obtained a complete dismissal with prejudice of claims of false or misleading advertising, affirmed on appeal. (D. Or. & 9th Cir. 2023, 2023 WL 3143690)

Licea v. Vitacost.com, Inc.

Successfully moved to dismiss all claims in privacy class action based on alleged violations of California Invasion of Privacy Act through use of a chatbot. (S.D. Cal. 2023, 2023 WL 5086893)

O'Neil v. The Kroger Co.

Obtained a complete dismissal with prejudice of all claims in California state court class action matter relating to alleged false advertising and unfair competition of food products. (Los Angeles Sup. Ct. 2020)

Valenzuela v. The Kroger Co.

Successfully moved to dismiss privacy class action against website operator. (C.D. Cal. 2023, 2023 WL 4418887)
