Missy Mordy's practice is focused on employment litigation, defending employers of all sizes against discrimination, wrongful termination, hostile work environment, retaliation, and wage and hour claims. Missy teams with her clients to understand their wants and needs before diving headfirst into a litigation. She strives to always provide her clients with efficient and practical solutions. She has significant trial experience and knows how best to position a case for resolution—both in and out of the courtroom.

While Missy focuses her practice on litigating cases in court, she is also a skilled advisor to clients seeking proactive solutions to employee-related questions. She frequently advises clients on severance and termination issues, performance management concerns, and trade secret and noncompete issues. She also has a niche specialty in wage and hour laws and frequently advises employers on issues relating to overtime, minimum wage, and job classifications, among others.

Missy also conducts trainings for clients and their employees on various employment law topics, including preventing sexual harassment, effectively managing employees, and wage and hour compliance. She has extensive experience conducting workplace investigations.

Prior to joining Davis Wright Tremaine, Missy worked as a litigation paralegal for Shearman & Sterling LLP in New York and as an extern for the Honorable Thomas Zilly in the U.S. District Court for the Western District of Washington.

Practice Highlights

Victories in the courtroom

Obtained a complete defense verdict in a three-week jury trial in King County Superior Court. Initially granted partial summary judgment on behalf of technology company in former employee's wrongful termination, negligence, and age and race discrimination lawsuit. Subsequent jury trial led to a complete defense verdict on former employee's remaining claims of gender discrimination, retaliation, and hostile work environment. (2014-2016)

Pre-trial success with wrongful termination claims

Granted summary judgment for technology client on claims of wrongful termination in violation of public policy brought by two former employees. Affirmed by Washington Court of Appeals. Washington Supreme Court denied petition for review. (2017-2019)

Joint employment expertise

Successful judgment for client, Expert Janitorial, following multi-day bench trial. Also granted partial summary judgment on wage and hour claims. Decision was appealed to the Washington Court of Appeals, which reversed and remanded. Washington Supreme Court issued first impression decision with new standard for determining joint employment. (2011-2014)

Bittner v. Symetra Life Insurance Co.

Former 10-year employee alleged that client, Symetra, discriminated, retaliated and failed to accommodate him, and also failed to pay him all commissions owed. After a contentious litigation, DWT successfully dismissed plaintiff's discrimination, failure to accommodate, and retaliation claims on summary judgment. DWT then obtained a complete defense verdict following multi-day jury trial on plaintiff's remaining wage and commission claims. (King County, 2022-2023)

Tabak v. Microsoft

Former employee alleged retaliation and failure to accommodate a disability. After some limited discovery, including plaintiff's deposition, plaintiff accepted offer of judgment for reasonable amount to favorably resolve the case prior to summary judgment and trial. (King County, 2022-2023)

Chandler v. International Marine & Industrial Applicators LLC

Reached favorable early settlement in a wage and hour collective and class action alleging compensation owed on per diem expenses. (Western District of Washington, 2022)

Cornwell v. Microsoft

Granted complete summary judgment for client, Microsoft, in claim of unlawful retaliation. Decision was affirmed by Washington Court of Appeals. Washington Supreme Court reversed and remanded on issue of the appropriate standard for "causation." Favorably resolved prior to trial. (King County, 2015-2019)

Timothy Fahey v. Alaska Airlines

Granted partial summary judgment for client, Alaska Airlines, in lawsuit by former employee alleging harassment, wrongful termination, retaliation, and discrimination claims. Remaining claim favorably resolved on eve of trial. (King County, 2018-2019)
