Jonathan Segal is an attorney with a passion for digital and traditional media, who has worked on award-winning productions in film, television, and the interactive space. His practice naturally focuses on intellectual property, communications, First Amendment, and other issues that affect the companies and technologies that make what we watch, amuse and delight us, and inform all of our worldviews. Jonathan fights for content creators if things go awry, defending against the full array of claims that arise from content production and distribution.

Accordingly, clients retain him to focus on high-risk content including docudramas ("Spotlight," "The Looming Tower"); docuseries ("Surviving R. Kelly," "Who Killed Tupac?"); documentaries ("13th," "Quincy"), and comedy/variety programs with heavy emphases on fair use ("@Midnight;" "The Joel McHale Show").

Jonathan believes in your work. He helps content creators get their creative vision onto the screen, while minimizing legal risk. He’s provided counseling for feature films and for programming produced or distributed by HBO, Legendary Television, Netflix, Seeso, Funny or Die, CNBC, E!, USA Networks, AETN, ABC, Comedy Central, Netflix, Hulu, Amazon, Participant Media, MTV, VH1, Adult Swim, IFC, TruTV, Showtime Networks, PBS, Discovery Communications, SuperDeluxe, Crackle, and YouTube, with an emphasis on programming with intensive social-media engagement, documentaries, and content that is based on true events. He also advises print publications, including US Weekly and The Hollywood Reporter.

Practice Highlights

Defending content creators

Defending producers of scripted and unscripted content from claims arising from their content. Recently, he's obtained dismissal of a Right of Publicity claim related to the character played by Tom Cruise in "American Made," and obtained complete victory and attorneys' fees in a negligence lawsuit filed against Viacom by the rapper Jayceon Taylor ("The Game") related to casting on the unscripted television series "She's Got Game."

Docudramas and biopics

Helping writers and producers find the tricky balance between fact and fiction demanded for production of a compelling docudrama is rewarding. Jon has worked on numerous projects inspired by or based on true stories including "Spotlight," "The Looming Tower," "The Green Book," "I'm Dying Up Here," and "On The Basis of Sex."

Holding government accountable

Helping publications and journalists gain access to public records and court proceedings. Jon has sued to obtain classified memoranda about the CIA’s secret targeted-killing program, the confidential records about the Archdiocese of Los Angeles’ coverup of child abuse, and government reports about police officers’ killing of an unarmed teenager.

Regularly counsels the producers of feature-length films, documentaries, and video games regarding right of publicity, life rights, copyright, trademark, and defamation issues, often on projects that tackle sensitive topics and involve substantial fair use issues ("Fire in Paradise," "Spotlight," "Funny or Die Presents Donald J. Trump's The Art of the Deal," "Anomalisa," "Winning: The Racing Life of Paul Newman," "Virunga," "Finding Vivian Maier," "Prophet's Prey," "Deliver Us From Evil," "West of Memphis," "Tales of the Grim Sleeper," "South Park: Stick of Truth," "South Park: Fractured But Whole," "Whitney: Can't I Be Me?"and "On the Record"). OneTaste v. Netflix

Obtained complete dismissal of high-profile defamation case over documentary "Orgasm Inc.," which explored the controversial "sexual wellness" organization OneTaste, whose leaders were indicted for alleged forced labor conspiracy after the film's release. Court granted our Anti-SLAPP motion and awarded full attorney fees in six-figure range. (Cal. Super. Ct. 2024) Previously, in a related matter also against Netflix, we defeated an unconstitutional attempt to enjoin the film's distribution on the eve of its release. (Cal. Super. Ct. 2022)

Keya Morgan v. The Hollywood Reporter et al.

Successfully defended The Hollywood Reporter in a defamation complaint filed in state court in Los Angeles by the former business manager of comics legend Stan Lee arising from an April 2018 feature story entitled: "Stan Lee Needs a Hero: Elder Abuse Claims and a Battle Over the Aging Marvel Creator." DWT'S anti-SLAPP motion was granted in January 2020. (Los Angeles Cty. (Cal.) Sup. Ct. 2020)

Frigon v. Universal Pictures

We represented Universal Pictures in right-of-publicity litigation arising from the 2017 Tom Cruise film "American Made," which chronicles the life of Barry Seal, a cocaine smuggler and CIA informant assassinated by Colombian drug lords in 1986. One of Seal's daughters, the executor of his estate, alleged that the studio was required to obtain her consent to make the film and asked the court to set aside a life rights agreement between the producers and several of Seal's other relatives. Defendants won a motion to dismiss and anti-SLAPP motion in September 2016, and were awarded $50,000 in fees and costs. A Louisiana appellate court affirmed, finding that the right of privacy dies with the individual, Louisiana has not recognized a right of publicity, and the challenged actions "were in the exercise of free speech." The Louisiana Supreme Court denied the plaintiff's petition for review in January 2019. U.S. right of publicity law is inconsistent, with relatively few cases in states like Georgia and Louisiana, where more film and TV production occurs. (Louisiana 2019)
