Jaime D. Walter partners with employers to navigate state and federal employment laws in order to both prevent—and defend against—litigation. Jaime understands that, besides being costly, litigation can be stressful. As a result, Jaime continuously keeps clients abreast of litigation developments; anticipates client needs; and presents solutions, rather than only problems.

Jaime represents employers in a spectrum of litigation issues, from wage-and-hour class and collective actions and California Private Attorneys General Act (PAGA) representative actions to defending against harassment, discrimination, retaliation, defamation, wrongful termination, and breach of contract claims, among others. Jaime has practiced not only at the trial and appellate court levels, but also before administrative agencies. She also regularly counsels clients to identify simple solutions that comply with state and federal law.

Jaime has worked with clients in a broad range of industries, including healthcare, retail, food and beverage, financial services, telecommunications, technology, fitness, media, hospitality, insurance, manufacturing, entertainment, and transportation.

Practice Highlights

Settled PAGA action on individual basis

Settled a PAGA action, involving hundreds of employees, on an individual basis and for nuisance value after meeting and conferring with opposing counsel regarding the defects in his client's claims—and before any depositions were taken.

Compelled putative class action to arbitration

Successfully moved to compel arbitration in putative wage-and-hour class action, which then had to proceed as a single-plaintiff case in arbitration.

Won early summary judgment

Secured summary judgment in commercial dispute against information technology company without ever having to defend the company at deposition.

Obtained early walk-away settlement

Convinced plaintiff to dismiss workers' compensation retaliation action with prejudice after marshaling and presenting favorable facts.

Convinced plaintiff to settle PAGA case on individual basis

Settled a PAGA action, involving hundreds of employees, on an individual basis and for nuisance value after meeting and conferring with opposing counsel regarding the defects in his client's claims—and before any depositions were taken. (Los Angeles Cnty. (Cal.) Super. Ct. 2019)

Successfully moved to compel arbitration

Compelled arbitration in putative wage and hour class action, which then had to proceed as a single-plaintiff case in arbitration. (Solano Cnty. (Cal.) Super. Ct. 2019)

Obtained summary judgment for information technology company*

Secured complete dismissal of breach of contract claims. (Santa Clara Cty (Cal.) Super. Ct. 2018)

Reached favorable resolutions for national retail employers*

Represented national retailers in wage and hour class action and Private Attorneys General Act actions, some brought on behalf of hundreds of employees and others brought on behalf of thousands of employees who sought wages and/or penalties for alleged noncompliant meal and rest breaks, unpaid minimum and overtime hours, noncompliant wage statements, failure to pay all wages due during employment and upon termination, unreimbursed business expenses, and unfair competition. (2013-2018)
