David Zins is a leader in employment class action litigation. He represents a wide array of California employers in and out of the courtroom, with a focus on defending leading retailers, manufacturers, financial institutions, and tech companies in high-stakes disputes over wage-and-hour matters. He has a long track record of defeating putative class actions, Private Attorneys General Act (PAGA) representative actions, and Fair Labor Standards Act (FLSA) collective actions. He also has significant experience defending employers against claims of wrongful termination, employment discrimination, retaliation, and other kinds of employment liability. When litigation arises, David is his clients' most zealous advocate and their most trusted advisor.

In addition to winning in court, David maintains a robust employment counseling practice. Drawing on his extensive experience with workplace issues, his advice helps clients optimize their employment practices, avoid litigation altogether when possible, and set themselves up to win when challenged.

Before practicing law, David worked in human resources and other management roles at a supply-chain company, where he spearheaded people management activities, implemented an active approach to employee relations, and ensured compliance with all applicable employment laws and regulations. A Harvard Law graduate recognized for excellence in labor, employment, and immigration law, David is seen as a "rising star" (Super Lawyers), a "top labor and employment lawyer" (Daily Journal), and a "leader of influence" (Los Angeles Business Journal) in California.

David has spent his legal career recruiting and mentoring younger attorneys, particularly those from the LGBTQ+ community, and he maintains a robust pro bono practice focused on LGBTQ+ advocacy and employment counseling in the nonprofit space – efforts that have garnered repeat recognition by the California Lawyers Association.

Defends clients in wage-and-hour class, collective, and PAGA representative actions, with a long track record of winning cases through aggressive litigation, intelligent motion practice, defeating class certification, developing factual and legal arguments to eliminate or narrow claims, winning at trial, securing appellate affirmance of trial court victories, and other strategies.

High-stakes discrimination and retaliation claims

Represents clients in high-stakes discrimination and retaliation claims, partnering with clients to chart roadmaps to desired outcomes, navigating agency proceedings, developing the record to favor client-friendly results, and engaging in dispositive motion practice, among other strategies.

Litigation avoidance

Advises clients with respect to wage-and-hour and other employment-related compliance issues, assessing and developing strategies to mitigate legal risk presented by various workplace practices, detecting and remediating issues before they ripen into disputes, and thinking outside the box to devise and help clients implement creative solutions to difficult legal challenges.

Defeated class certification in kitchen-sink wage-and-hour case*

Defeated certification of kitchen-sink wage-and-hour class action in its entirety on behalf of leading manufacturer and distributor of health and beauty products.

Dismissal of PAGA action alleging kitchen-sink wage-and-hour liability*

Following class denial in companion case, obtained dismissal of PAGA action in its entirety by causing plaintiff to abandon case through aggressive litigation.

Dismissal of PAGA action alleging independent contractor misclassification*

In PAGA action alleging misclassification of direct sellers as independent contractors, used successful Viking River motion to compel arbitration of plaintiff's individual PAGA claims as leverage to extract dismissal of entire action in exchange for nuisance-value individual settlement.

Defeated class certification in meal and rest premium case*

Defeated class certification of claim that retail client failed to pay meal and rest premiums at the correct regular rate of pay.

Defeated class certification in rounding case*

Defeated class certification in putative class action alleging that supply-chain client engaged in unlawful rounding of time.
