On November 8th, partner Christina Chan will join the panel, "CLE 102 | DocGPT Will See You Now: Advising in the New Era of Generative Health AI." There has never been a better time than now to be an attorney in the digital health sector. Almost everyone has heard of ChatGPT and the news has been full of both positive and negative stories about the uses of AI in healthcare. For many of us, this is the first time that our friends and family think our jobs are cool. But, as they say, with great power comes great responsibility. While generative AI is a game-changer for the health sector – bringing opportunities to reduce provider burnout, reach historically underserved populations, and improve the quality of patient care – it also comes with a host of legal and ethical issues. These include questions about who owns, controls, and is responsible for the AI-generated content; how to protect and regulate the data and algorithms used by generative AI; and how to ensure the safety, accuracy, and fairness of the AI-generated content. To effectively counsel in these areas – issue spotting and advising on risk mitigation strategies- digital health attorneys need to grasp more than just the legal and data issues. We must also understand how providers and patients interact with these tools daily; recognize the potential for algorithmic bias and its roots stemming from historical oppression of minority communities; and comprehend the underlying technology (data science 101). This panel is comprised of medical and legal professionals who specialize in the intersection of health and technology, including generative AI. They will discuss the current state and future trends of generative AI in the health sector (focusing on radiation oncology clinical use cases); the legal challenges and opportunities it creates; and the skills and competencies that attorneys need to succeed in this dynamic and evolving field.
