NYSDOL Releases Required Notice of Employee Rights Under Section 740 of the New York Labor Law
As detailed in our prior advisory, New York significantly expanded whistleblower protections under Section 740 of the New York Labor Law and created a posting requirement for employers to inform employees of their protections, rights, and obligations under Section 740.
The New York State Department of Labor (NYSDOL) has now released the required notice to employees (available here). Specifically, the notice states that it must be posted conspicuously in easily accessible and well-lighted places customarily frequented by employees and applicants for employment. For employees who are fully remote, this notice should be provided by e-mail and included in the remote employee's standard onboarding documentation.
We will continue to monitor NYSDOL's promulgation of further guidance regarding Section 740, including model notices, and will provide additional advisories when that guidance is issued.
