In almost three decades of practice, Brad Fisher has tried cases in state and federal courts, arbitrated dozens of disputes, and successfully argued numerous appeals to the Ninth Circuit and Washington Court of Appeals. He has obtained and resisted temporary restraining orders and preliminary injunctions in non-compete and trade secret matters, and defeated a long list of consumer class actions. Brad regularly represents healthcare clients in administrative proceedings before the Department of Health, in medical staff proceedings, and other civil litigation. He defends clients against claims brought by both the Attorney General and private litigants under the Consumer Protection Act, the False Claims Act, and similar statutes, and represents both plaintiffs and defendants in all variety of commercial disputes. Brad’s clients include healthcare providers, financial institutions, law firms, technology companies, franchisors, and manufacturers, as well as individuals.

Certificate of Need litigation

Regularly and successfully represents numerous healthcare providers in certificate of need proceedings, in both administrative hearings and subsequent court proceedings. (Ongoing)

"Chargemaster" litigation

Represents hospitals and health systems in defending putative class actions alleging that chargemaster rates violate state contract and tort laws, as well as claims related to the provision of charity care. (Ongoing)

Debt collection

Regularly and successfully represents creditors, law firms, and collection agencies in defending against claims under the Fair Debt Collection Practices Act and Washington Collection Agency Act, securing dismissal of dozens of claims on motion practice. (Ongoing)

Washington State Hospital Association v. Washington State Department of Health

Represented the hospital association in a successful challenge to a state certificate-of-need regulation regarding changes in control of a hospital. Obtained ruling from superior court that the regulation is invalid. The Washington Supreme Court affirmed in July 2015, in a unanimous decision. 183 Wn.2d 590 (2015)

Dickman v. IOD

Obtained summary judgment dismissing claims by putative class representative alleging that charges for medical records violated HIPAA and state law. (2015)
