With nearly 30 years of commercial litigation experience, Mary maintains a broad and diverse litigation practice handling a wide variety of breach of contract, fraud, and corporate governance matters. She has extensive experience in real property litigation, including easements, slander of title, and boundary disputes. As an experienced creditor's rights lawyer, Mary is also masterful in handling recalcitrant debtors, enforcing multi-million dollar judgments and utilizing pre-judgment remedies such as writs of attachment and security agreements. Mary is a "lawyer's lawyer", with a practice supporting entertainment companies, financial institutions, healthcare providers, and real estate companies. She is seen as a trusted advisor who is sought out for guidance and strategies from both her clients and colleagues on how best to handle complex litigation issues.

Real Estate Litigation

Aghchay v. Philbert Trust et al.

Defended property owner against quiet title action by neighbor seeking an easement by necessity over a 500-acre parcel as well claims for trespass, and diversion of surface waters. After a six-day bench trial, complete defense verdict and was awarded attorney’s fees. (2016)

Blanco v. County of Santa Barbara, et. al.

Representing property owner in writ petition and declaratory relief action seeking permits from county to complete construction of residence and enforcement of right of way easement rights. (Ongoing)

Defending property owner against claims brought by neighbor for breach and interference of driveway easement. (Ongoing)

Toyo Tire & Rubber Co., Ltd v. Doublestar Dong Feng Tyre Co.

Represented U.S. tire manufacturer in efforts to collect a $1.6 million contempt order against Chinese tire company. (2018)

Roadrunner Transportation Services, Inc. v. Tarwater

Represented Roadrunner as creditor in enforcement of over $400,000 judgment. (2018)

Freestone Capital Partners v. MKA Real Estate Opportunity Fund

Represented Freestone in a multi-jurisdictional matter involving the enforcement of written guarantees exceeding $32 million indebtedness. Obtained summary judgment against the two individual guarantors who resided in California. (2012)

Weissman v. Cooperative of American Physicians, Inc., et al.

Represented members of the board of trustees of Mutual Protection Trust (MPT) in writ of mandamus proceedings brought by terminated members of Cooperative of American Physicians (CAP), seeking reinstatement to the organization and board of trustees.
