Class action defense has long constituted a significant portion of our litigation practice. As a result, we are experienced in handling the unique strategic, procedural, and management challenges presented by class actions. Our lawyers have successfully defended hundreds of class actions for major companies in almost every industry throughout the country.
A Record of Success
Our strategy is to resolve class actions early through motions to dismiss, summary judgment, challenges to class certification, or settlement. Some of the strategies and tactics we use in defending against complex class actions include:
- Precluding class certification by using dispositive motions to defeat the individual claims of the class representatives
- Obtaining dismissal of class actions by mooting the claims of the class representatives
- Establishing that plaintiffs lack standing, are inadequate class representatives, or have claims that are atypical of the class
- Moving the court for entry of a trial plan (and seeking bifurcation of the common and individual issues) to highlight the unmanageability of a putative class action
- Seeking interlocutory appellate review of unfavorable trial court decisions
- Structuring class settlements to minimize costs to our clients

Consumer
Alcorn v. Verizon Wireless
Defending Verizon Wireless in putative nationwide consumer class action alleging that defendants design their products to result in accidental data charges. (Ongoing)
Casault v. Freddie Mac et al.
Served as lead counsel for Freddie Mac in consumer class action against all major lenders and loan services alleging improper foreclosures based on the theory that loan-servicer advances in securitized mortgage backed securities cured any default by the borrower. Responsible for drafting and filing the lead joint brief for Freddie Mac, Fannie Mae, Wells Fargo, US Bank, Aurora Loan Services, Bank of New York Mellon, and LaSalle bank. Obtained motion to dismiss, and affirmance on appeal to the 9th Circuit. 658 Fed. Appx. 872 (9th Cir. 2016)

Representing large wireless carrier in ongoing consumer class action. (Ongoing)
Crosby v. Laemmle Theatres, LLC
Represented theatre company in putative California class action alleging claims under the ADA and Unruh Civil Rights Act related to provision of assistive listening devices and captioning in theatres. Resolved favorably. (C.D. Cal. 2014)
Crosby v. Pacific Theatres Exhibition Corp.
Represented theatre company in putative California class action alleging claims under the ADA and Unruh Civil Rights Act related to provision of assistive listening devices in theatres. Resolved favorably. (C.D. Cal. 2015)
Dancer v. Los Angeles Times Communications LLC
Represented Los Angeles Times Communications LLC in putative class action alleging the company left prerecorded messages on cell phones in violation of the TCPA. Settled favorably. (Los Angeles Cnty. (Cal.) Super. Ct. 2014)
Halaburda v. Bauer Publishing Co.
Defended magazine publishers in putative class action alleging violations of Michigan's Video Rental Privacy Act based on alleged disclosure of subscribers’ personal information. Class settlement was approved. (E.D. Mich.)
Hetherington v. Omaha Steaks, Inc. and Omaha Steaks Int'l, Inc.
Defended leading food manufacturing, marketing, and distribution company in putative nationwide class action alleging the company placed automated and prerecorded messages to cell phones in violation of the TCPA and state common law. (D. Or. 2016)
Lane's Gifts v. Microsoft
Represented Microsoft Online Inc. ("MOI") in putative class action alleging MOI misrepresented the characteristics of websites comprising its online advertising network. Case settled. (W.D. Wash. 2015)
Leyse, et al. v. Lifetime Entertainment Services, LLC
Defended Lifetime Entertainment (A&E) in putative class action for allegedly making unauthorized telemarketing calls in violation of Telephone Consumer Protection Act. Defeated class certification. Successfully opposed class certification and entry of judgment in the district court which was affirmed by the 2nd Circuit. (2017)

Hafez Daraee and Brooks Cooper, et al. v. Microsoft Corporation
Represented Microsoft in a class action brought by purchasers of the Microsoft Windows 98 operating system, who claimed they were overcharged in violation of antitrust laws. Successfully obtained dismissal of the case at the pleading stage. (Multnomah Cnty. (Or.) Cir. Ct. 2000)

Defending supplier of ladders in products liability class action alleging manufacture and sale of defective products. (W.D. Wash. 2012; Ongoing)
Greenwood et al. v. Jaguar Land Rover North America LLC
Defended automobile importer and distributor in a putative class action asserting claims for violations of the Washington Consumer Protection Act based on alleged defect in tire alignment in certain vehicles. Resolved favorably through settlement. (C.D. Cal. 2013)
Rasmussen et al. v. Pacific Webworks, Inc.
Represented online provider of work-at-home products in putative class action alleging company improperly charged for inadequately disclosed products and services in violation of the Washington Consumer Protection Act and other claims. Case settled on favorable terms. (W.D. Wash. 2012)
Schumacher v. Amazon
Represented online retailer in putative class action in California federal district court against product liability and warranty claims. Obtained dismissal. (2012)
Consumer Legal Remedies Act class action
Represented international beauty products manufacturer in response to pre-litigation California Consumer Legal Remedies Act claims made by purchasers of various products. Litigation was avoided with an early, positive settlement. (Los Angeles Cnty. (Cal.) 2011)
Geise v. Amazon.com
Represented Amazon.com in putative nationwide product liability and consumer class action alleging that the Amazon Kindle was defective and had a propensity to crack. Case was settled for $50,000 and with no discovery costs incurred. (2010)
In re Xbox 360 Scratched Disc Litigation
Represented Microsoft in putative nationwide products liability class action alleging defects in the Xbox 360 console. Court denied class certification in October 2009, and the 9th Circuit denied review on Jan. 21, 2010. In re Xbox 360 Scratched Disc Litig., 2009 WL 481325 (W.D. Wash. 2009). Case settled on favorable terms on individual basis. (W.D. Wash. 2010)

Hudson v. Citibank
Representation of Citibank in defense of class action for alleged violation of Unfair Trade Practices Act. Prevailed on motion to compel arbitration on individual basis only, now on appeal to Alaska Supreme Court. (Ongoing)
LaChapelle et al. v. Kim et al.
Defending shareholder derivative action brought against directors and largest investing entity. After jury trial in September 2014, argued in front of the Oregon Court of Appeals, September 2017; awaiting decision from the court. (Or. App. Ongoing)
Amerivest Financial, LLC v. Pacific Northwest Title and Escrow Company, et al.
Defended Pacific Northwest Title against claims under Oregon Securities Act and for allegedly aiding and abetting breach of fiduciary duty, fraud, and breach of contract. Obtained complete defense verdict after two-week trial. (Multnomah Cty. (Oregon) Circuit Court). Affirmed by Oregon Court of Appeals, 263 Or.App. 327. Case No. 080201987; A144457 (Court of Appeals of Oregon 2014).
Gordon v. Microsoft Corporation
Defended Microsoft and its Board against claims of a putative class of shareholders seeking to enjoin annual meeting based on allegedly inadequate proxy disclosures concerning executive pay and employee incentive compensation plan. After Microsoft filed a motion to dismiss, plaintiff dismissed with prejudice. (King Cnty. (Wash.) Super. Ct. 2012)
In re Washington Mutual Inc. Securities Litigation
Defended former executive officers of Washington Mutual in multi-district federal securities class actions and tag-along cases arising from WaMu’s failure. Appointed by the court as liaison counsel for all defendants. The case was settled through mediation. (W.D. Wash. 2011)
Aventa Learning, Inc. et al. v. K12, Inc. et al
Defended K12 Inc. and its affiliate in Washington State Securities Act (WSSA) claim. Settled shortly before trial. (W.D. Wash. 2011)
RE Sources for Sustainable Comm., et al. v. Building Indus. Assoc. of Wash.
Successfully defended trade association at trial in multimillion-dollar class action and breach of trust litigation brought by political opponents in an effort to deprive association of its ability to spend revenue on political speech. (Thurston Cnty. (Wash.) Super. Ct. 2010)
Warlick v. Fatburger Holdings, Inc.
Defended corporation and its directors in California action against claims arising from claimed breach of fiduciary duty, in connection with issuance of stock options. (Los Angeles Cnty. (Cal.) Super. Ct. 2009)
Estate of Robert S. Felts v. Genworth Life Ins. Co.
Defeated motion for certification of a nationwide class for state law claims arising out of the sale of single premium fixed annuities. (W.D. Wash., 2008)

Represented Nokia, Inc., in PSLRA securities class action. Briefed and argued successful motion to dismiss on the pleadings. (W.D. Wash. 2007)
